The Eligibility Process
The Eligibility process for Aid and Attendance Benefits is complex. The basic information is available for you from the VA but be advised that if you apply and your application is denied, you may have to wait a year before you can reapply. For these reasons, many people seek assistance in the eligibility process.

Unfortunately, there are too few attorneys or "VA Planners" who have specialized knowledge in this particular area of legal practice due to the fact that it is illegal to charge a veteran a fee for submitting an application to file a claim for benefits. Veterans Service Organizations (VSOs) are often hard-pressed to have sufficient resources to assist multiple generations of veterans, so it is often difficult for a veteran or his/her spouse to get help in filing a claim. Sadly, “a veteran who turns to the VA for information about veterans benefits might want to get a second opinion". According to the VA’s own data, people who call the agency’s regional offices for help and advice are more likely to receive completely wrong answers than completely right ones.”
Any individual assisting a veteran must take into account the impact of Medicaid eligibility, tax issues, selling a home, and a host of other interrelated issues. Any individual who does not provide this comprehensive approach is doing the claimant a disservice and could cause devastating financial problems.
Don't Forget Medicaid
Eventually you may find yourself needing to apply for Medicaid benefits because the cost of long term care is still beyond your means even with the VA benefits. When applying for Medicaid in PA, NJ and DE another important factor that one must consider when thinking about trying to meet the VA asset limitation test is that giving away cash or other things of value can create terrible problems for senior citizens when they later need to apply for Medicaid to assist them with skilled nursing, assisted living or at- home care. Giving away assets can create a long penalty period of ineligibility for Medicaid benefits. Any senior facing long-term care needs to seek capable advice from someone who is skilled in the areas of financial planning, Medicaid, Medicare, income tax, and gift tax, as well as having experience regarding VA rules.
Your VA Planner [whether an attorney or not] MUST also be extremely knowledgeable regarding ALL Medicaid rules, they should ALSO offer Medicaid Planning AND have extensive experience in filing Medicaid applications and working directly with the state Medicaid agencies and caseworkers. IF NOT be VERY cautious. The planning advice that they give may be a big issue later when you apply for Medicaid benefits.

Be Wary of Planners that Sell Insurance and Annuities
Another common source of information regarding VA benefits generally comes from salespeople who often offer to consult with veterans and their families. This offer is based on the strategy of counseling the veteran to meet the asset and income limitations of the benefit by buying an annuity. In reality, the annuity salesperson is being compensated by the annuity company for selling a financial product to the veteran.
An annuity may be an excellent financial decision or a poor one, depending on the facts and circumstances. All we are saying is: You should seek independent advice before making a decision to purchase an annuity.
